What is social dumping?

Social dumping

Social Dumping is when foreign or domestic companies work in Denmark and do not act in conformity with Danish laws and regulations. It might be that:

  • Employees are not paid according to a collective agreement
  • Employees are not paid for all performed working hours
  • Employees do not receive overtime payment and/or retirement benefits and other salary components.
  • Employees have poor working conditions

What we do?

SamAqua checks if the social clauses that our utilities make with their suppliers and sub-suppliers are compliant. Social clauses can be skill training clauses, apprentice clauses, and labour clauses etc.

The utilities in SamAqua use The Common Labour Clause for Funen and a supplier or sub-supplier is obligated to act accordingly to the clauses concerning salary and conditions of employment. This clause is at the same level as the most representative collective agreement for the area. SamAqua performs controls of documentation and inspections of construction sites etc. 

At an inspection, SamAqua visits the site in which the supplier works for one of our utilities. At the inspection, the focus is on the employees’ working conditions and SamAqua collects information about suppliers and sub-suppliers working at the site, who is working at the site and what their terms and conditions of their employment. If the observations or collected information causes suspicion concerning a non-compliant working clause, there will be a document check performed. 

The checking of documents can be performed apart from an inspection or in addition to an inspection or as a random compliance check. The main supplier will be asked to provide relevant documents such as pay slips, time sheets, and employment contracts etc. for the employees involved. The submitted information is controlled, compared and evaluated regarding laws and relevant collective agreements in force. Subsequently, it is possible for the utility to impose the supplier a fine, withhold payments and ultimately cancel the agreement if the supplier is not compliant with the agreement in question.
